Hot tubs and spas in Apple Valley are regulated as spas under the California Swimming Pool Safety Act, which the Town enforces through its adopted California Residential Code. A building permit is required, and a new or remodeled spa at a single-family home must include at least two of seven drowning-prevention safety features.
The Town of Apple Valley applies the same framework to spas and hot tubs as to swimming pools. Under Health and Safety Code 115922, a spa is included in the definition of a pool or spa, so when the Town issues a building permit for a new spa or a remodel at a private single-family home, the spa must carry at least two of the seven approved drowning-prevention features. A common alternative for spas is an approved safety cover meeting ASTM F1346, which can serve as one of the two required features in place of a full isolation enclosure. Electrical work for a spa - including bonding and a properly rated disconnect - is inspected during the permit process under the adopted California Residential and Electrical Codes. Self-contained portable spas are still subject to permit and inspection in Apple Valley, though the safety-cover option often satisfies the barrier requirement for these units. As with pools, the Town has not adopted a stricter local spa ordinance; the substantive requirements come from California law and are enforced locally by the Building and Safety Division.
Installing a spa or hot tub without the required Town permit, or without at least two qualifying safety features, fails inspection and bars lawful use. Improper electrical bonding is a code violation that must be corrected before final approval.
