Apple Valley enforces the California Swimming Pool Safety Act through its adopted California Residential Code. New or remodeled residential pools and spas must include at least two of seven approved drowning-prevention safety features, which can include an isolation enclosure, an ASTM-rated safety cover, door and gate alarms, or an in-water alarm.
Because the Town of Apple Valley has adopted the 2022 California Codes (Title 24, Parts 1-12), pool safety is governed by Health and Safety Code 115922. When the Town issues a building permit for a new pool or spa, or for a remodel of an existing one at a private single-family home, the pool or spa must be equipped with at least two of the following seven features: (1) an enclosure meeting Section 115923 that isolates the pool from the home; (2) removable mesh fencing meeting ASTM F2286 with a self-closing, self-latching, lockable gate; (3) a manual or power safety cover meeting ASTM F1346; (4) exit alarms on doors and windows with direct pool access; (5) a self-closing, self-latching device on the door to the pool with a release no lower than 54 inches above the floor; (6) an in-water alarm meeting ASTM F2208; or (7) other equivalent protection verified by an approved testing laboratory. These are minimum statewide requirements that Apple Valley applies locally through its plan-check and inspection process; the Town has not adopted a stricter local pool-safety standard.
A pool or spa that does not carry at least two of the seven required drowning-prevention features will not pass final inspection and cannot be lawfully used. Disabling or removing required safety features after approval is a code violation enforced by Town Code Enforcement.
