Cal. Health & Safety Code §115922 (as amended by SB 442 effective 2018) requires that on issuance of a building permit for construction of a new swimming pool or spa, or remodeling of an existing pool or spa, at the private single-family home of any person, the pool or spa must be equipped with AT LEAST TWO of the following seven drowning prevention safety features: (1) an enclosure meeting §115923, (2) removable mesh fencing meeting ASTM F2286 with self-closing self-latching key-lockable gate, (3) a manually or power-operated safety pool cover meeting ASTM F1346-23, (4) exit alarms on home doors with direct pool access, (5) a self-closing self-latching device on doors with direct pool access with release no lower than 54 inches above the floor, (6) an alarm placed in the pool that activates on accidental or unauthorized water entry meeting ASTM F2208, or (7) other means of protection providing equivalent protection. Chino Building Division final inspection verifies installation. Suction outlet entrapment protection under the Virginia Graeme Baker Pool & Spa Safety Act and CEC Art. 680 GFCI bonding also apply.
A permit cannot receive final sign-off without verified installation of two SB 442 features. Subsequent removal or disabling (cover taken off and discarded, exit alarm batteries pulled, etc.) is a code violation and can be cited by Chino Building & Code Enforcement. Drowning-incident civil liability typically follows non-compliance.
