Hesperia follows the California Swimming Pool Safety Act (Cal. HSC §§115920–115929). At new pool construction or any pool/spa remodel requiring a building permit, the property must have at least two of seven drowning prevention safety features, verified at final inspection by the Hesperia Building & Safety Division. State law occupies the field; there is no separate Hesperia pool safety ordinance.
Under Cal. HSC §115922(a), any private single-family residential pool or spa permitted for construction or remodel on or after January 1, 2018 must be equipped with at least two of these seven drowning prevention features: (1) an isolation enclosure meeting §115923; (2) removable mesh fencing per ASTM F2286 with self-latching gate; (3) an ASTM F1346 safety pool cover; (4) exit alarms on doors providing direct pool access; (5) a self-closing/self-latching door device with release at least 54 inches above the floor; (6) an ASTM F2208 alarm that detects unauthorized water entry; or (7) another approved means providing equivalent or greater protection. A combined alarm + self-latching device on the same door does NOT count as two features (HSC §115922(b)). The Hesperia Building & Safety Division verifies installation and inspects pursuant to HSC §115922(c) and Title 24 CCR. At sale of a property with a pool/spa, the home inspector must identify which safety features are present (HSC §115925).
A building official may not approve final construction unless at least two compliant safety features are present (HSC §115922(c)). Continued violation can result in withholding of certificate of occupancy and code-enforcement action under HMC Title 8 general nuisance authority.
