Hot tubs and spas in Cleveland are regulated as pools when capable of holding more than 24 inches of water, requiring a permit and barrier. Units with locked, UL-listed safety covers meeting ASTM F1346 are exempt from the 48-inch fence requirement. Electrical permits and GFCI protection are required for all hard-wired tubs.
Cleveland Codified Ordinances Part 13 and the Ohio Residential Code classify any water-containing vessel deeper than 24 inches as a swimming pool for permitting and barrier purposes, including hot tubs and spas. Portable spas that plug into a standard 120-volt outlet and hold more than 24 inches still technically meet the definition, but the Ohio code provides an exemption from the 48-inch barrier requirement if the spa is equipped with a locked, rigid safety cover listed and labeled to ASTM F1346. Covers must be lockable, removable only with a key or tool, and capable of supporting an adult walking across them. Hard-wired 240-volt spas require an electrical permit, a dedicated GFCI-protected circuit, and bonding of all metal components under NEC Article 680. A building permit is required for hard-wired installation, deck framing that supports the spa, and any barrier work. Setback rules for accessory equipment apply, typically three to five feet from lot lines. Chemical storage must be secured and away from heat sources. Noise from pumps at night falls under the general noise ordinance requiring no unreasonable disturbance after 11 pm. Swim spas that combine exercise flow with soak zones are treated like pools for barrier purposes unless the ASTM F1346 cover exemption applies.
