The Building Services Fence Building Guide implementing LMC 15.05.100 states that 'all hot tubs and spas shall be enclosed by fencing... not less than four feet in height' with openings no larger than 4 inches and a gate latch meeting the city's adopted codes. The guide explicitly allows an alternative: 'In lieu of fencing, spas and hot tubs may have a lockable cover capable of supporting a minimum of one hundred fifty pounds, and such cover shall be locked when such spa or hot tub is not in use.' This locked-cover allowance differs from the rule for pools (where a barrier is always required). Longmont's 2021 IRC Appendix V (adopted Jan. 1, 2022) also recognizes the ASTM F1346-compliant locked safety cover as an approved alternative for spas. Electrical hookups must comply with 2020 NEC Article 680 (GFCI protection, equipotential bonding). A final inspection is required.
Installing a hot tub or spa without a permit, or operating one without either a 4-foot fence or a locked-and-rated safety cover, is a code violation. The city can require correction, charge re-inspection fees, and pursue code enforcement. Failing to lock the cover when the tub is unattended creates serious child-drowning liability.
