Per the Building Services Fence Building Guide (LMC 15.05.100), all swimming pools deeper than 24 inches and all hot tubs and spas must be enclosed by fencing 'of a type that is not readily accessible by children and that contains no opening larger than four inches.' The minimum height is 4 feet, and if equipped with a gate the gate must have a latch meeting the city's adopted codes. Because Longmont adopted the 2021 I-Codes effective January 1, 2022, 2021 IRC Appendix V (Section AV105) provides the detailed barrier standard: 48-inch minimum height measured on the side facing away from the pool; horizontal members spaced at least 45 inches apart (or, if less, with mesh openings no larger than 1-3/4 inches); maximum 2-inch clearance between bottom of barrier and grade (4 inches if on top of a solid surface); gates self-closing and self-latching, opening outward away from the pool, with the latch release at least 54 inches above the bottom of the gate. Where a wall of the dwelling forms part of the barrier, doors opening directly to the pool area must be equipped with an alarm or other approved means of protection.
A pool will fail final inspection and may not be filled or used until a compliant barrier and gate hardware are installed. Disabling or propping open a self-latching gate, or removing an alarm on a dwelling door, is a code violation creating serious liability.
