When the County issues a building permit for a new or remodeled pool or spa at a single-family home, California's Swimming Pool Safety Act requires at least two of seven approved drowning-prevention features, plus anti-entrapment drain protection. The County applies these state standards through its adopted building codes.
Unincorporated San Mateo County enforces the California Swimming Pool Safety Act (Health & Safety Code 115920-115929) through its Title 10 building regulations. Under HSC 115922, when a building permit is issued for the construction of a new swimming pool or spa, or the remodeling of an existing one, at a private single-family home, the pool or spa must be equipped with at least two of seven drowning-prevention safety features: (1) an enclosure isolating the pool from the home that meets HSC 115923; (2) removable mesh fencing meeting ASTM F2286 with a self-closing, self-latching, key-lockable gate; (3) an approved safety pool cover meeting ASTM F1346; (4) exit alarms on doors/windows with direct pool access; (5) a self-closing, self-latching door device with a release no lower than 54 inches above the floor; (6) an alarm that sounds on entry into the water meeting ASTM F2208; or (7) other approved means providing equal protection, independently verified. Separately, HSC 115928 requires new pools to use anti-entrapment suction outlet covers/grates (ANSI/APSP-16 standard) or skimmer/perimeter overflow circulation systems to prevent suction entrapment. Final approval to use the pool is conditioned on these features being installed and verified at inspection.
If the required two-of-seven safety features or anti-entrapment protections are absent, the County will not approve the pool or spa for use; the permit can be held open and the owner remains liable for an unsafe, non-compliant installation.
