When applying for a private swimming pool building permit, the applicant must show approval from the Board of Health of Toms River Township regarding the suitability and adequacy of design, materials, construction specifications, and all accessory equipment. The application must identify the building lot, residence location, pool location, all accessory equipment, pool type, dimensions, step and diving board locations, and enclosure specifications. A building permit is required for any pool that can contain water over 24 inches deep. Pools must be located behind the front building setback line and at least 8 feet from any building or railing on an elevated deck (hot tubs and spas under 501 gallons are exempt from the 8-foot rule).
