Consumer fireworks are illegal in New Jersey under N.J.S.A. 21:3-1. Since 2017 (P.L. 2017, c.74), only hand-held sparklers, ground-based sparklers, smoke devices, and novelty items are legal for adults. Toms River Bureau of Fire Prevention recommends attending public displays only.
New Jersey law (N.J.S.A. 21:3-1) bans the sale, possession, and use of consumer fireworks including firecrackers, Roman candles, bottle rockets, and aerial devices. Public Law 2017, Chapter 74 legalized certain non-aerial items: hand-held sparklers, ground-based sparklers and fountains, smoke devices, and novelty items such as snakes, poppers, and snappers. These may only be purchased and used by persons 16 years of age or older. The Toms River Bureau of Fire Prevention actively discourages private fireworks use and recommends attending professional public displays.
