ADU Rules

New Jersey has NO statewide mandate requiring municipalities to permit accessory dwelling units (ADUs). Senate Bill S2347 (2024-2025 session) โ€” which would have authorized ADUs by right on single-family lots โ€” died in committee and was reintroduced as S1786 in January 2026, pending in the Senate Community and Urban Affairs Committee. Until a statewide bill is enacted, zoning authority over ADUs rests with each of New Jersey's 564 municipalities under the Municipal Land Use Law (N.J.S.A. 40:55D et seq.).
