New Jersey Fireworks Law Limits Consumer Use Statewide

Under N.J.S.A. 21:3-3 (as amended by P.L. 2017, c. 92), persons 16 and older may purchase and use ground-based sparkling devices, snakes, glow worms, and smoke devices. Firecrackers, bottle rockets, Roman candles, mortars, and any aerial or audible explosive device remain unlawful. The Division of Fire Safety regulates display fireworks under N.J.A.C. 5:70-3A. Municipalities cannot legalize banned devices but may impose additional local conditions on permitted novelties.

Possession or use of prohibited fireworks is a disorderly persons offense punishable by up to 6 months in jail, a fine up to $1,000, and seizure of the items.
