Elizabeth, NJ Fire Regulations: Fireworks (2026)

Under Chapter 5.38, adopted under the state Fireworks Regulation Law (N.J.S.A. 21:2-1 et seq., as amended by P.L. 2017, c. 92), no person or entity may sell or distribute seasonal fireworks, sparkling devices, or novelties without a valid permit from the bureau of central license (Section 5.38.030). Section 5.38.040 bans permit holders from selling or possessing firecrackers, torpedoes, skyrockets, Roman candles, bombs, toy guns or cannons using explosives, and any device containing nitrates, chlorates, or similar explosive compounds. Permit holders may sell only novelty snap caps with 0.25 grain or less of explosive compound per cap, and sparkling devices and novelties to buyers 16 or older.

Applications must be filed with the chief license inspector by April 15, accompanied by a $100 nonprorated fee, and require fire official review against the Fire Prevention Code (Chapter 15.08) before a permit is granted (Section 5.38.050). Permits run for a single season, May 1 through September 15, are nontransferable between persons or locations, and must be displayed prominently on the premises. Temporary sales structures must be fire-retardant with proof displayed, set at least 15 feet from any other structure and from any public street or right-of-way, and must keep a working fire extinguisher on site (Section 5.38.060).

Permit holders must allow the bureau of central license or fire department to inspect the premises at any reasonable time, with or without notice (Section 5.38.070).
