New York enforces strict residential pool safety through the 2020 NY Residential Code Appendix G and NY Executive Law Section 387(14), administered locally by Onondaga County towns' building departments. Any pool built or substantially modified after December 14, 2006 must have an approved pool alarm meeting ASTM F2208, capable of detecting entry at any point on the water surface. Door alarms are required on doors from the dwelling directly leading to the pool. All drains and suction outlets must have anti-entrapment covers compliant with the federal Virginia Graeme Baker Pool and Spa Safety Act (VGBA). At sale, the NY Property Condition Disclosure Act requires sellers to disclose pool presence and condition. Permits from the local building department are required for all in-ground and above-ground pools deeper than 24 inches. Syracuse and most Onondaga towns additionally require GFCI protection on all pool electrical circuits.
Pool alarm violations: fines up to $5,000 and/or 15 days imprisonment per day of violation under Executive Law. Signage violations: $500 first, $1,000 subsequent. Unpermitted pools: stop-use orders and removal.
