PA 90 of 2020 clarified retailer compliance and ID verification. MDHHS Tobacco Section conducts compliance checks alongside the FDA. Retailers must verify ID for any buyer reasonably appearing younger than 27. Sale, gift, or furnishing to a person under 21 is a misdemeanor. Local governments may add licensing requirements but Michigan has no statewide flavor ban.
Retailer civil fines start at $100 for a first violation and escalate to $500+ for repeats within a 12-month window, plus possible suspension of Tobacco Products Tax Act licenses. Furnishing to a minor is a misdemeanor under MCL §722.641.
