Under amendments to NY Public Health Law adopted in 2020, the sale and distribution of flavored vapor products, except for those approved by the FDA with tobacco flavor only, is prohibited statewide. The ban covers menthol, mint, fruit, dessert, and any characterizing flavor in e-liquids and pre-filled cartridges. Enforcement is shared by the NY Department of Health and local agencies including NCDOH. Nassau County also separately bans the sale of flavored tobacco within its jurisdiction under a 2019 county local law, layering on top of state restrictions, with strong enforcement against neighborhood smoke shops.
