Glen Cove City Council exercised the New York State Marihuana Regulation and Taxation Act (MRTA) local opt-out before the December 31, 2021 deadline, prohibiting adult-use cannabis retail dispensaries and on-site consumption lounges within the city.
Under MRTA § 131, municipalities had a one-time opportunity to opt out of allowing adult-use retail dispensaries and consumption sites by December 31, 2021. Glen Cove joined many Nassau County municipalities in opting out. The opt-out is reversible only by affirmative future city action; it does not affect possession or use of cannabis by adults 21+, which is legal under state law citywide. Medical cannabis dispensaries operate under separate state authority and were not affected by the opt-out vote.
Operating an unlicensed cannabis dispensary is enforceable under state law (NYS Office of Cannabis Management penalties) and local zoning code under § 1-15.
