Under Maryland Business Regulation Article and Health-General Article 16.7A, retailers selling electronic smoking devices and vape liquids must obtain an Other Tobacco Products retail license issued by the Comptroller. Stores must verify ID for any buyer appearing under 30, post age-of-sale signage, and may not sell through self-service displays except in adults-only tobacco stores. The 2024 Cannabis and Tobacco Reform legislation expanded oversight of vape sales. Sales to anyone under 21 are prohibited, and online sales must use age-verification at delivery.
Unlicensed retail sales or sales to minors carry civil penalties up to $300 per first offense and $1,000 for subsequent violations, plus license suspension.
