Tulare Municipal Code Chapter 7.17 implements California's SB 1383 mandate. Every single-family home, multifamily building, and business in Tulare must subscribe to recycling AND organics collection and source-separate organics, recyclables, and landfill trash. As of 1/1/2022 it is illegal statewide to put organics or recyclables in the trash cart.
TMC Chapter 7.17 (Mandatory Recycling and Organic Waste Disposal Reduction) implements Cal. Pub. Res. Code Β§ 42652 et seq. (SB 1383). All properties β residential and commercial β must subscribe to organic and recycling collection services through the City's hauler, or demonstrate (via self-haul records to a permitted compost/recycling facility) that the divertible material is being legally diverted. Tulare's three-cart system: BLACK = landfill trash; BLUE = mixed recyclables (paper, cardboard, plastic bottles/jugs, metal cans, glass bottles); GREEN = organics (food waste, food-soiled paper, plant debris, yard trimmings, untreated/unpainted wood). Commercial generators of large volumes of organics may also be subject to AB 1826 (Cal. Pub. Res. Code Β§ 42649.8) and AB 341 commercial recycling requirements. SB 1383 also requires edible-food recovery: Tier 1 generators (supermarkets, large food wholesalers/distributors, food service providers) and Tier 2 (restaurants, hotels with on-site food, large venues, state agencies) must contract with a food recovery organization to donate edible surplus.
City SB 1383 fines for contamination of carts (e.g., organics in the trash, trash in the recycling): $50 first violation, $100 second violation, $250 third and subsequent violations. Failure to subscribe to required organics or recycling service is independently enforceable under TMC Β§ 7.16.030 (compulsory service) and TMC Ch. 7.17. CalRecycle can also pursue state-level penalties against the jurisdiction, which the City flows down to non-compliant generators.
