Tulare Municipal Code § 7.16.030 makes garbage, recycling, organics, and street-sweeping service compulsory for every dwelling, apartment, and place of business. Service is provided through the City's Department of Public Utilities — you cannot opt out, self-haul as your primary disposal method, or refuse to pay.
Under TMC § 7.16.030 (last amended by Ord. 18-05, 9-18-2018), all dwellings, apartment houses, and places of business in which garbage, recyclable materials, or organic materials accumulate within the City, or upon abutting public streets, are required to use the City's collection and disposal and street sweeping services and pay the fees set by the Department of Public Utilities (§ 7.16.150). The City's residential program now uses the SB 1383 three-cart system — black trash, blue recycling, green organics — each serviced weekly. Residential collection hours are roughly 6:00 a.m. to 5:00 p.m. SB 1383 (Cal. Pub. Res. Code §§ 42652–42652.5) layered a statewide mandate on top: as of January 1, 2022, organic and recyclable materials cannot be placed in trash containers; City enforcement with monetary penalties began January 1, 2024.
Failure to subscribe to mandatory City service is a violation of TMC § 7.16.030 and chargeable as a municipal infraction; the City may also place delinquent service charges as a lien against the property. SB 1383 contamination fines (per the City's adopted enforcement schedule) start at $50 for a first violation, $100 for a second, and $250 for a third or subsequent violation, in addition to any charges under Cal. Pub. Res. Code § 42652.5.
