Recycling is mandatory in unincorporated Sarasota County under the Solid Waste and Recyclable Materials Collection Ordinance (Ch. 106, adopted per Ord. 2006-001). It is unlawful to knowingly mix recyclables into the trash stream (Sec. 106-55).
Sarasota County's charter and code establish a Mandatory Recycling Program for unincorporated areas, providing residential curbside collection of Program Recyclables and requiring commercial customers to recycle designated materials, construction and demolition debris, and yard trash from commercial lawn services. Sec. 106-55 makes it unlawful to knowingly combine recyclables with other solid waste, or to dispose of recyclables improperly. Once set out at curbside, recyclables become county property (Sec. 106-51). Materials required to be recycled under Florida Statute 403.706 cannot be removed from the county's recyclable list.
Mixing recyclables into trash is a code violation; Code Enforcement issues a warning then citation, and unauthorized removal of set-out recyclables may be a misdemeanor.
