Daly City Municipal Code Chapter 8.80 (Mandatory Organic Waste Disposal Reduction), added by Ordinance No. 1452 (adopted Nov 22, 2021, effective Jan 1, 2022), implements California SB 1383. All residents and businesses must subscribe to green-cart organics service combining yard trimmings, food scraps, and food-soiled paper. Putting yard waste in trash or recycling is a violation.
California SB 1383 (Lara, 2016) requires 75% statewide reduction of organic waste disposal by 2025. Daly City complies via Municipal Code Chapter 8.80, added by Ordinance No. 1452 adopted by the City Council on November 22, 2021 and effective January 1, 2022. The ordinance makes participation in green-cart organics collection mandatory for ALL single-family residences, multi-family dwellings (apartments, condominiums), and businesses, unless an approved waiver applies. The green cart accepts: yard trimmings (grass clippings, leaves, weeds, small branches up to a typical 4-inch diameter and 4-foot length), food scraps including spoiled produce, leftovers, meat, dairy, and bones, and food-soiled paper such as napkins, paper plates, pizza boxes, and uncoated paper food packaging. Plastic bags (even compostable plastic without BPI/CMA certification on Republic's accepted list), pet waste, diapers, plastic produce stickers, and treated/painted wood are NOT accepted. Residents may use a kitchen pail to collect food scraps and transfer them to the green cart. Yard waste exceeding the green cart should be scheduled as part of the free annual bulky goods pickup or hauled to Ox Mountain Sanitary Landfill ((650) 726-1819). California Public Resources Code §42652.5 authorizes jurisdictions to impose enforcement penalties of $50–$500 per violation per day after a warning period.
Single-family violations during the state's tiered enforcement program may begin with notices and education, escalating to administrative fines of $50 first violation, $100 second, and $250 third per CalRecycle's SB 1383 framework (PRC §42652.5). Commercial and multi-family generators face higher penalties up to $500/day. Repeat or willful non-subscription to organics service is enforceable under Chapter 8.80.
