Trees of historical or environmental significance on Township-owned property β including Thomas A. Edison Memorial Tower grounds β receive enhanced protection. Middlesex County also identifies notable trees within the county park system.
Edison Township's general Code does not establish a standalone heritage-tree registration program of the type adopted in some Bergen County and shore-region municipalities. Instead, individual specimen trees on private property can be designated for protection as a condition of site-plan or subdivision approval by the Edison Planning Board under Chapter 37 (Zoning) β once designated, those trees cannot be removed without Planning Board modification of the approval. Removing a specimen tree designated as a condition of an Edison Planning Board site-plan approval without first amending the approval is a zoning violation: Chapter 1 Β§1-5 fines ($100β$2,000 per offense), potential stop-work order, and required replacement plantings. Damage to historically protected trees on State property is enforced by NJDEP or the State Historic Preservation Office. Damage to county park trees is enforced under Middlesex County Park Regulations.
