Cedar Park requires a construction or site development permit before removing any tree on public right-of-way or any protected tree (8-caliper-inch or larger) on a development site under Article 14.07 of the Code of Ordinances.
Under Cedar Park Code Article 14.07 (Tree & Landscape Requirements), no person may remove a tree from public right-of-way without first obtaining a valid construction permit issued by the chief building official. For development sites, all existing 8-inch caliper or larger trees (measured one foot above ground) are protected and require an approved site development permit from the Development Services Department demonstrating compliance with the article. Clearing of only brush and scrub cedars using rubber-tired equipment is not considered 'development' and is exempt. All vigorous existing 4-inch caliper or larger hardwood trees within the 25' front setback area must be retained and protected as a landscape buffer (except within driveway areas). Texas Local Government Code Β§212.905 (added by HB 7, 2017) caps municipal authority by requiring cities that charge tree mitigation fees to allow at least a 40% (non-residential) or 50% (residential) credit for replanting; Cedar Park's mitigation framework complies with this state cap.
Removal of a protected tree without a permit is a Class C misdemeanor under Texas Local Government Code Β§54.001 enforcement. General penalty under Cedar Park Code Β§1.01.009 allows fines up to $500 per day for code violations, and up to $2,000 per day for violations of health/safety/zoning ordinances. Each tree removed without a permit may be charged as a separate offense, and the city may also impose mitigation fees of $150 to $450 per diameter inch removed without authorization.
