Chapter 126 of the Miami Beach Code (Landscape Ordinance) establishes comprehensive tree protection. Section 126-5 prohibits cutting down, destroying, moving, or effectively destroying through damaging any tree that normally matures to a height of at least 20 feet, except through the city's permit procedures. The Environment and Sustainability Department administers tree removal permits and conducts site inspections. Permit applications require identification of the tree species, size (diameter at breast height), condition, and reason for removal. The city arborist evaluates whether the tree is dead, diseased, hazardous, or in conflict with approved construction. Healthy trees generally cannot be removed unless replacement trees of equivalent value are provided. Miami Beach's tropical climate supports valuable species including gumbo limbo, live oak, royal palm, coconut palm, and tropical hardwoods. Removing a protected tree without a permit is a serious code violation carrying fines based on the tree's appraised value, which can reach thousands of dollars for mature specimen trees. Violators must replace trees at ratios determined by the city. Stop-work orders may be issued for construction that damages protected trees.
