Denton's Development Code does not impose a citywide owner-occupancy requirement for the by-right first ADU on a lot. However, the January 2026 amendment requiring a Special Use Permit (SUP) for any second ADU enables City Council to attach owner-occupancy and other conditions case-by-case. Texas has not preempted local owner-occupancy rules for ADUs (unlike California). University of North Texas-area properties face heightened scrutiny.
Unlike many Texas cities, Denton's Development Code (DDC) does not currently impose a citywide owner-occupancy requirement on the first by-right ADU under Subchapter 5 use regulations. A property owner may construct an ADU and rent both the principal dwelling and the ADU under long-term arrangements provided each remains in compliance with use regulations. However, the January 2026 code amendment requiring a Special Use Permit (SUP) for any second ADU on the same lot gives Denton City Council discretion to attach owner-occupancy as a condition of approval case-by-case after a public hearing. SUP conditions are recorded against the property with Denton County Clerk and run with the land. Texas state law has not preempted local owner-occupancy rules (no statute analogous to California's AB 976), so Denton retains full authority to impose them through SUP, PUD overlay, or future code amendment. Properties near the University of North Texas (UNT) and Texas Woman's University (TWU) face heightened scrutiny for potential rental conversion - the dense student-housing market makes ADUs attractive investments and Denton has tightened short-term rental rules separately in response to neighborhood concerns. Long-term tenants must still meet Denton's residential occupancy limits and any HOA covenants applicable in master-planned communities like Robson Ranch, Vintage, and Wind River.
Operating an ADU in violation of an SUP condition (when an SUP is required) is a code enforcement matter. The city may revoke the SUP and Certificate of Occupancy. Fines up to $500 per day apply under Texas Local Government Code Β§ 54.001. False statements on permit applications can void the permit and trigger Class C misdemeanor charges.
