Travis County Code Section 252.006 adopts the state's Dangerous Dog process under Health and Safety Code Section 822.047: a sworn incident report, an ACA investigation, and a hearing officer's finding can label a dog dangerous, triggering mandatory registration, $100,000 insurance, a secure enclosure, and criminal exposure for the owner.

Full Breakdown

047. Anyone can file a sworn incident report with the ACA describing an unprovoked attack; ACA field officers investigate, and a hearing officer, someone separate from the investigators, takes testimony before deciding by a preponderance of the evidence whether the dog qualifies. If the dog is found dangerous, the owner has 15 days to appeal to a court of competent jurisdiction, and during any appeal must either meet the Dangerous Dog requirements or post a bond set by the court. 00 liability policy or equivalent financial responsibility, keep the dog inside a locked, escape-proof, publicly-inaccessible Secure Enclosure marked as containing a dangerous dog, keep current rabies vaccination on file, and pay the ACA's annual registration fee.

Moving the dog requires notifying the ACA of the new address within 14 days and paying a re-registration fee. An owner who fails to comply can be taken to court; if the court finds noncompliance it orders the ACA to seize the dog, and the owner then has 11 days to show compliance and pay all costs before a court can order the dog destroyed, or 15 days total before an unclaimed dog is destroyed. The status follows the dog even if ownership changes, and a new owner inherits every requirement.

Violations & Fines

An owner whose Dangerous Dog attacks a person commits a Class C misdemeanor, rising to a Class A misdemeanor if the attack causes serious bodily injury or death, plus a civil penalty of up to $10,000.00 collectible by the county attorney. Keeping a Dangerous Dog without meeting the registration, insurance, and secure-enclosure requirements is a separate Class C misdemeanor, a Class B misdemeanor on a second conviction, and can result in court-ordered seizure and destruction of the dog.

Frequently Asked Questions

What makes a dog 'dangerous' under Travis County rules?
A dog is a Dangerous Dog under Section 252.006 if it attacks or acts toward a person outside a secure enclosure, without provocation, causing bodily injury or a reasonable belief it will attack and cause injury. The ACA investigates a sworn incident report and a hearing officer separate from the investigation decides the case.
Can I appeal a Dangerous Dog determination?
Yes. Section 252.006(a)(6)(A) gives the owner 15 days to appeal to a court of competent jurisdiction. While the appeal is pending, the owner must either meet the Dangerous Dog compliance requirements, such as the secure enclosure and insurance, or post a bond the court sets in place of compliance.
What has to happen for me to keep a Dangerous Dog?
Within 30 days you must register the dog annually with the ACA, prove $100,000.00 in liability insurance or equivalent financial responsibility, keep current rabies vaccination, keep the dog in a locked, marked Secure Enclosure or on a leash under direct control, and report any move within 14 days.
