Section 4.02.001.A defines "vicious dog" purely by conduct: unprovoked attack-postures toward people in public, a known propensity to attack or injure, actually biting or attacking without provocation, or being kept for dog fighting. A dog of any breed can be declared vicious under this test; no breed is presumed dangerous or banned outright. Once declared vicious, the owner must confine the dog in a secure enclosure, muzzle or cage it off-property, carry at least $100,000 in liability insurance, and post a warning sign. Wilmington and Newark run their own municipal codes, separate from this County ordinance, and could set different rules within their city limits.
