Pasco County cannot enforce breed-specific legislation. Florida Statute Β§767.14 preempts all local breed-specific dog regulations statewide. Dangerous dog designations are behavior-based under FL Β§767.01-767.04.
Florida Statute Β§767.14 preempts breed-specific legislation statewide. No Florida city or county can enact breed bans. Miami-Dadeβs pit bull ban was grandfathered from before the 1990 preemption but was repealed by voter referendum in October 2023. Dangerous dog designations under FL Β§767 are based on individual behavior, not breed. Owners of dangerous dogs must meet strict containment, insurance ($100,000 liability), and registration requirements. HOA breed restrictions may exist in CC&Rs but are private rules, not city code.
Dangerous dog violations: misdemeanor to felony depending on severity. Containment failure: $500+. Severe attack: felony charges.
