Summary

Unincorporated Waukesha County does not ban any dog breed. Instead, under Sec. 14-453 through 14-459 of the County Code, the Administrative Officer investigates bite and attack incidents and can declare a specific animal "Dangerous" or "Prohibited Dangerous," triggering enclosure, muzzling, insurance and microchip requirements or a countywide ban.

These county ordinances apply to unincorporated areas of Waukesha County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a) An Owner of an animal declared to be a Dangerous Animal shall meet the following conditions: 1. Any animal declared to be a Dangerous Animal shall be confined in a secure enclosure while on the premises of the Owner. 2. No Dangerous Animal shall be allowed off the premises of the Owner unless such animal remains: i. Inside a secure animal carrier; or ii. Under the Direct Control of such Owner and securely muzzled and restrained by a chain with a minimum tensile strength of three hundred (300) pounds. (b) Within thirty (30) days of the determination and order, the Owner of any animal declared to be a Dangerous Animal shall comply with all of the following requirements and provide documentation evidencing such compliance to the Administrative Officer: 1. Proof of liability insurance specifying coverage for personal injuries inflicted by the Dangerous Animal, 2. Have a microchip implanted in the Dangerous Animal, 3. Provide a current color photograph of the Dangerous Animal, and 4. Further conditions established by the Administrative Officer on a case-by-case basis.

Full Breakdown

Waukesha County regulates dangerous animals by individual conduct, not breed, under Division 2 of Chapter 14, adopted under Wis. 54(6). The Department of Parks and Land Use's Environmental Health Manager (the "Administrative Officer") investigates reports arising from the county's rabies control program and, on reasonable grounds, issues a written determination and order declaring an animal "Dangerous" (Sec. 14-456). A Dangerous Animal must stay in a secure enclosure on the owner's property; off-property it must ride in a secure carrier or be under direct control, muzzled and restrained by a chain rated at a minimum 300-pound tensile strength (Sec.

14-457(a)). Within 30 days the owner must document liability insurance covering injuries the animal causes, implant a microchip, provide a current color photo, and meet any case-specific conditions the Administrative Officer sets (Sec. 14-457(b)). An owner who instead surrenders the animal must prove euthanasia or report the new owner's name, address and microchip data at least 24 hours before transfer (Sec. 14-457(c)). A "Prohibited Dangerous Animal," defined to include any animal already declared dangerous elsewhere, trained for fighting, subject to destruction under Wis. 02(3), or one that inflicted severe bodily harm or death, is barred from the county entirely and must be euthanized or removed within 30 days (Sec.

14-458(a)-(b)). Owners may contest either declaration by filing a written objection within 30 days for administrative review under Sec. 18-154; pending that review, the animal is held under the Dangerous Animal conditions (Sec. 14-456(d), 14-458(c)). Sec. 14-459 exempts on-duty police canines and injuries sustained by someone committing a crime, trespassing, or provoking the animal.

Violations & Fines

Missing the 30-day compliance or surrender deadline under Sec. 14-457(b)-(c) or Sec. 14-458(b) can bring a citation under the county's Sec. 66.0113 citation authority, issued by the Director of Parks and Land Use or a designated employee. A Dangerous Animal involved in a second qualifying incident can be escalated to a Prohibited Dangerous Animal declaration, and failure to comply after that determination can lead a court to order the animal euthanized if no compliance is shown.

Frequently Asked Questions

Does Waukesha County ban pit bulls or other breeds?
No. The county's ordinance regulates dangerous animals by documented behavior, not breed. An animal is only restricted after the Administrative Officer investigates a bite, attack or injury and issues a written declaration under Sec. 14-456, regardless of its breed.
What must I do if my dog is declared a Dangerous Animal?
Within 30 days you must confine it in a secure enclosure, provide proof of liability insurance, have it microchipped, submit a current photo, and keep it muzzled and chained with 300-pound-rated restraint whenever it leaves your property, per Sec. 14-457.
Can I appeal a dangerous animal declaration in Waukesha County?
Yes. Sec. 14-456(d) lets an owner file a written objection within 30 days of the determination and order for administrative review under Sec. 18-154. The animal is held under Dangerous Animal conditions while the review is pending.
What happens if an animal is declared Prohibited Dangerous?
Sec. 14-458(a) bars it from the county outright. The owner has 30 days to prove euthanasia or document a transfer of ownership with the new owner's address and the animal's microchip information, or face citation or a court-ordered euthanasia.
