(a)The Animal Services Director shall make an initial determination that an Animal is a Vicious Animal based upon any of the criteria listed below:(1)Any Animal which aggressively bites, attacks, endangers or has inflicted severe injury on a human being on public or private property;(2)Any Animal which has more than once severely injured or killed a Domestic Animal while off the Owner's property;(3)Any Animal which has been used primarily or in part for the purpose of fighting or is trained for fighting;(4)Any Animal which, without adequate provocation, chased or approached a person upon the streets, sidewalks, or any public grounds in a menacing fashion or apparent attitude of attack, provided that such actions are attested to in a sworn statement by one or more persons and dutifully investigated by the appropriate authority; and(5)Any Dog defined and certified as a Dangerous Dog under Chapter 767, Florida Statutes.

Sec. 14-40(a) authorizes the Animal Services Director to make an initial 'Vicious Animal' determination when an animal aggressively bites, attacks or severely injures a person; has more than once severely injured or killed another domestic animal off the owner's property; has been used or trained for fighting; has chased or menacingly approached a person without provocation; or has already been certified a Dangerous Dog under Chapter 767, Florida Statutes.

A Vicious Animal that is not confined and subsequently bites or attacks puts the owner in violation regardless of the confinement order (subsection (n)). The Special Magistrate's order is final but is appealable to Circuit Court within 30 days on the administrative record, not a new hearing (subsection (h)(13)).

Failing to register, sterilize, microchip or securely confine a declared Vicious Animal is itself a violation of Sec. 14-40(j), and Animal Services may impound the animal at the owner's expense; if the owner still has not met the requirements within seven days of impoundment, the animal is deemed abandoned and becomes county property under Sec. 14-40(o)(1). Owners also bear all boarding, veterinary and legal costs tied to enforcement (subsection (p)).
