Summary

Lee County’s animal chapter names no banned breed. It regulates individual animals by behavior: the animal services director declares an animal dangerous, which triggers confinement, muzzling, signage and registration duties.

These county ordinances apply to unincorporated areas of Lee County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

This act does not limit any local government from adopting an ordinance... placing further restrictions or additional requirements on owners of dogs that have bitten or attacked persons or domestic animals... provided that no such regulation is specific to breed.

Full Breakdown

Section 4-33 lets the director of animal services declare an animal dangerous under the County Administrative Code or state law. A declared animal must be confined in a secure enclosure and may leave the premises only inside a secure carrier, or under the owner’s physical control while muzzled and restrained by a chain of at least 300 pounds tensile strength and no more than three feet long. Release from impound requires microchipping, sterilization, rabies vaccination, registration fees and Dangerous Animal signs at all entry points. Breed appears once: after a conviction under subsection (g), you may not keep that breed for three years.

Violations & Fines

Refusing or failing to confine or restrain a declared dangerous animal violates the article; the animal may be impounded and citations issued, and conviction bars owning that breed for three years.

Frequently Asked Questions

Can Lee County ban pit bulls?
The county animal chapter names no breed as banned. It works through dangerous-animal declarations based on an individual animal’s behavior, and adopts Florida’s animal-control laws by reference in section 4-22.
Can my HOA still restrict breeds?
The county code does not address private covenants. Chapter 4 governs vaccination, licensing, animals at large and dangerous-animal declarations, not deed restrictions or association rules.
