Milpitas requires all dogs to be physically restrained on a leash whenever they are off their owner's property. The Municipal Code does not specify a leash length. Off-leash dogs are allowed only in designated off-leash areas, such as the City's dog park at Ed Levin Park. Field enforcement is handled by San Jose Animal Care and Services.
Under Milpitas Municipal Code Section V-210-4.05 (Dogs Shall be Leashed, part of Chapter 210, Animal Regulations), all dogs must be physically restrained by means of a leash when they are not on the property of their owner or the person who has control of them. The City's published code does not state a specific maximum leash length, so the requirement is simply that the dog be leashed and under control off its own property. Related nuisance provisions in Section V-210-4 prohibit allowing an animal to obstruct the comfortable use of public or private property, to chase vehicles, or to disturb passersby. Milpitas does not run its own animal control field unit; under contract, the City of San Jose Animal Care and Services responds to stray dogs running at large, animal cruelty complaints, and confined/trapped domestic animals for Milpitas (field services 408-794-7297). Milpitas Code Enforcement handles local nuisance complaints such as barking dogs and animal odors or waste. The City operates an off-leash dog park as a subfacility of Ed Levin Park at 3100 Calaveras Road; dogs must be leashed when entering and exiting and must remain under voice control inside the off-leash area.
A dog off its owner's property without a leash violates Municipal Code Section V-210-4.05 and may be impounded by San Jose Animal Care and Services, with the owner subject to citation. Dogs that chase vehicles or disturb passersby may also be cited as a nuisance under Section V-210-4.
