California Fish and Game Code §2118 preempts most exotic-pet rules in Lincoln, prohibiting possession of primates, most non-domestic carnivores, crocodilians, piranhas, and many other species without a state permit; Lincoln Municipal Code Title 6 supplements with local impound and dangerous-animal authority.
Under Cal. Fish and Game Code §2118 it is unlawful to import, transport, possess, or release alive into the state - except under a revocable, nontransferable permit - a wide list of restricted species. The list includes all non-human primates, marsupials, most rodents and carnivores (except domestic dogs and cats), giant toads, crocodilians, piranhas, gars, and certain birds in the corvid and starling families. Domestic rabbits, hamsters, rats, mice, guinea pigs and common livestock are exempt. California Department of Fish and Wildlife issues the limited permits described in 14 CCR §671. Lincoln's local code, organized under Title 6 (Animals) on the Municode portal, layers on impound authority for any animal kept in violation of state law and authorizes Placer County Animal Services (530-886-5500) to seize restricted species discovered in the city. Selling, breeding, or displaying a restricted animal without a CDFW permit can also be charged under Penal Code §597 if cruelty is involved.
Possession of a restricted species without a CDFW permit is a misdemeanor under Fish and Game Code §2125, punishable by a fine of $500 to $10,000 and/or up to 6 months in jail per animal, plus seizure and forfeiture of the animal. Lincoln Municipal Code Title 6 violations are infractions starting at $100 per Lincoln Municipal Code §1.16 and Gov. Code §53069.4.
