Tomball regulates exotic and wild animals under its animal control ordinance and Texas state law. Dangerous wild animals require registration under Texas Health and Safety Code Chapter 822. Many exotic species are prohibited in residential areas.
The City of Tomball regulates exotic and wild animals through its animal control ordinance and state law. Texas Health and Safety Code Chapter 822 Subchapter E requires registration of dangerous wild animals including lions, tigers, bears, chimpanzees, and other specified species. Keeping venomous snakes, large constrictor snakes, alligators, and other inherently dangerous animals in residential areas is generally prohibited under the city's nuisance and animal control provisions. Common exotic pets such as ferrets, non-venomous reptiles, and small birds are generally permitted as long as they do not create a nuisance. Potbelly pigs may be restricted depending on zoning district livestock regulations. All exotic animals must be kept in secure enclosures that prevent escape. Federal permits may be required for certain species under the Endangered Species Act or Lacey Act. Contact Tomball Animal Control through the Police Department for questions about specific species.
Keeping a dangerous wild animal without registration is a criminal offense under Texas law. Exotic animals creating a nuisance or that escape may be impounded. Fines and criminal charges may apply depending on the species.
