Full Breakdown
Suffolk County Code § 302-7(W), inside Chapter 302's Article I on animal shelters and rescues, bars a shelter or rescue from adopting out, bartering, or giving away any animal without first having it spayed or neutered. The sole exception is a written determination from a New York State-licensed veterinarian that the procedure would be unsafe for that specific animal. The Suffolk County Department of Health Services administers this article alongside the shelter's vaccination, isolation, and recordkeeping duties. The mandate binds licensed shelters and rescues themselves: it does not require private pet owners, breeders, or pet shops to spay or neuter animals they already own.
Violations & Fines
Enforced by the Suffolk County Department of Health Services as part of its oversight of shelters and rescues under this article; § 302-9 directs any fines collected under the article to the County's general fund within 30 days of receipt.
