Summary
Mendocino County will not place a dog or cat up for adoption from the County shelter unless it has been spayed or neutered, under Section 10.24.090(A). (A)Except as otherwise provided in this Chapter, the County shall not place for adoption any dog or cat that has not been spayed or neutered.(B)The County may transfer to a new owner a dog or cat that has not been spayed or neutered under the following circumstances:(1)The new owner signs a written agreement acknowledging the dog or cat is not spayed or neutered and agrees to be responsible for ensuring the dog or cat will be spayed or neutered within thirty (30) business days after the agreement is signed.

090(A) of the County Code bars Animal Care Services from placing any dog or cat up for adoption unless it has already been spayed or neutered. 090(B) if the adopter signs a written agreement to have the animal altered within thirty business days of signing, extendable up to eight months of age for animals too young for surgery, and pays a refundable deposit set by Board of Supervisors resolution within the limits of California Food and Agriculture Code Section 30521. 090(C). 020(A)(7) separately requires that every dog covered by a noncommercial kennel license be spayed or neutered, unless a veterinarian certifies the surgery would be unsafe, exempting working animals.
080(D), once a dog or cat is impounded a second time while unaltered, Animal Care Services may not waive the impound or penalty fees and must require the animal be spayed or neutered before release, with the owner paying both the impound fee and the spay/neuter cost into the dedicated trust account.
Violations & Fines
Redeeming an unaltered dog or cat from a second or later impoundment without paying for the required spay or neuter under Section 10.24.080(D) blocks the animal's release; Animal Care Services cannot waive that fee once the second impound occurs. An adopter who fails to have a newly adopted animal altered within the thirty business day window, or the extended period allowed for young animals, forfeits the spay/neuter deposit under Section 10.24.090(C)(1).
