Summary

Atlantic County will not release a dog or cat from its Animal Shelter until the animal has been spayed or neutered and given age-appropriate immunizations, under County Code § 4-35.1(B). The Division of Public Health runs the Shelter and bundles the surgery into adoption fees of $110 for dogs and $85 for cats.

These county ordinances apply to unincorporated areas of Atlantic County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A. The Atlantic County Animal Shelter is hereby authorized, in compliance with all statutory requirements and with all rules and regulations promulgated by the State Department of Health, to operate an Animal Shelter for the treatment, quarantine, euthanasia, distribution and any and all other appropriate services regarding stray or lost dogs and cats received by the Shelter.

B. No animal shall be released by the Shelter unless all age-appropriate veterinary services, including immunizations, spaying and neutering, have been provided.

Full Breakdown

1, added 9-12-1995 by Ordinance No. 9-1995 and last amended 6-7-2022 by Ordinance No. 5-2022, governs the County Animal Shelter operated within the Division of Public Health. Subsection A authorizes the Shelter to treat, quarantine, euthanize and place stray or lost dogs and cats received by it. Subsection B is the operative rule: no animal leaves the Shelter, whether through adoption by a new owner or redemption by its original owner, until it has received all age-appropriate veterinary services, including immunizations, spaying and neutering. Subsection C sets the fees that fund this mandate.

A canine adoption costs $110 and a feline adoption $85; both figures bundle the mandatory sterilization surgery with age-appropriate vaccinations, parasite testing (heartworm for dogs, feline leukemia/FIV for cats), a microchip implant, and a free follow-up visit to a participating veterinarian within seven days of adoption. 50. Redeeming rather than adopting an animal costs $4 per day of impoundment plus a $20 administration fee and any veterinary costs incurred, while an animal held on a biting quarantine costs $100 plus $10 for each day the quarantine period is exceeded.

Violations & Fines

Section 4-35.1 is enforced by the Shelter itself withholding release rather than through a citation issued to the public: sterilization and immunizations must be complete before any dog or cat leaves. Owners who surrender an animal and later change their mind forfeit the full surrender fee after 30 days under § 4-35.1C(2), and quarantined biting animals accrue $10 per day beyond the mandated quarantine period under § 4-35.1C(5).

Frequently Asked Questions

Does Atlantic County require all pet owners to spay or neuter their pets?
No. County Code § 4-35.1 only requires sterilization before the County Animal Shelter releases a dog or cat, through adoption or owner redemption. Atlantic County does not zone or license private pet ownership; a general spay/neuter mandate for pets already in a home would come from the municipality where the animal lives, not the county.
How much does a spayed or neutered shelter adoption cost in Atlantic County?
A canine adoption is $110 and a feline adoption is $85 under § 4-35.1C(1). Both fees bundle the mandatory sterilization surgery with age-appropriate vaccinations, parasite testing, a microchip, and a free veterinary visit within seven days of adoption. County employees receive a fifty-percent discount.
Who enforces the Atlantic County shelter spay/neuter rule?
The Atlantic County Division of Public Health, which operates the Animal Shelter under § 4-35.1, enforces the rule directly by withholding release of any dog or cat until spaying or neutering and age-appropriate immunizations are complete. There is no separate court process because it is a release condition, not a public citation.
What does it cost to surrender a pet to the Atlantic County shelter?
Under § 4-35.1C(3), surrender fees are $50 for a dog, $35 for a cat, and $20 for the first animal in a litter with $10 for each additional littermate. SPCA surrenders are accepted on a no-fee basis unless a court orders otherwise. These fees are separate from the sterilization requirement applied when an animal later leaves through adoption.
