Summary
Charles County's zoning ordinance treats veterinary hospitals as a use permitted with conditions in most commercial and mixed-use zones, but requires a special exception in rural and residential districts. Every site needs a half-acre lot, a fully enclosed soundproof building, and a 125-foot buffer from the nearest dwelling under standard 5.02.400.
5.02.400 Veterinarians and veterinary hospitals. This use is permitted with conditions in the HVC, HVG, CN, CB, CC, CV, BP, PEP, MX, TOD, CER, WC and AUC Zones and is permitted by special exception in the WCD, RR, RC(D), RV and RL Zones, subject to the following standards: A. The lot on which the use is located must be a minimum of 1/2 acre in size. B. The use must be housed in a fully enclosed, soundproof building. C. Except in the HVC, HVG, WC and AUC Zones, the use shall be located a minimum of 75 feet from any road or street and no less than 125 feet from the nearest dwelling. In the HVC and HVG Zones, the use shall be located at least 125 feet from the nearest dwelling and shall comply with the applicable setback requirements for the HVC and HVG Zones, codified in § 297-99 of this chapter. D. The use must conform to standards of the County Animal Regulations and applicable state and local laws.
Full Breakdown
400 of Charles County Code § 297-212 governs where veterinarians and veterinary hospitals may locate. The use is permitted with conditions, meaning no discretionary hearing is required beyond meeting the listed standards, in the Highway Village Commercial, Highway Village Gateway, Commercial Neighborhood, Commercial Business, Community Commercial, Commercial Village, Business Park, Planned Employment and Industrial Park, Mixed Use, Transit Oriented Development, Commercial Employment Residential, Waterfront Commercial and Airport Use Compatibility Zones. In the Waterfront Conservation District, Agricultural Conservation, Rural Commercial (D), Rural Village and Rural Legacy Zones, a veterinary hospital instead needs a special exception from the Board of Appeals, a discretionary permit that requires public notice and a hearing.
Every site, regardless of zone, must sit on a lot of at least half an acre and house the practice in a fully enclosed, soundproof building so noise and odor stay contained. Outside the Highway Village Commercial and Gateway, Waterfront Commercial and Airport Use Compatibility Zones, the building must sit at least 75 feet from any road or street and no closer than 125 feet to the nearest dwelling; inside the Highway Village Zones, the 125-foot dwelling setback still applies but the road setback instead follows § 297-99's Highway Village setback table. The use must also conform to the County's own Chapter 230 animal-care standards and applicable state veterinary-practice law.
Violations & Fines
A veterinary hospital sited or built without meeting the 5.02.400 standards, or the underlying special exception where one is required, is a zoning-ordinance violation enforced by the Charles County Department of Planning and Growth Management. The department can withhold or revoke a use-and-occupancy permit, and unresolved noncompliance can be referred for zoning enforcement action, including citations and required corrective site changes, before the practice may operate.
