Islip's Animal Ordinances: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles animal ordinances a little differently. In Islip, New York, there are 7 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Dog Leash Laws

Islip Town Code Chapter 15 requires dogs to be leashed (maximum 6 feet) on all public property including streets, parks, and beaches except in designated off-leash areas. Suffolk County Dog Control enforces alongside Town. Violations start at 50 dollars and escalate.

Key details: Max Leash: 6 feet. Beach Rules: Plover season stricter. Code: Islip Ch. 15. First Fine: 50 dollars. State Law: Ag and Markets 123.

First offense 50 dollars, second 100 dollars, third 250 dollars. Off-leash dog causing injury may result in dangerous dog proceedings under Ag and Markets 123.

This is not one of those rules that cities tend to ignore. Islip actively enforces its dog leash laws requirements.

Wildlife Feeding

Feeding deer is prohibited statewide under 6 NYCRR 189. Islip discourages feeding of waterfowl, raccoons, and feral cats under public nuisance provisions of Town Code. Great South Bay waterfowl feeding creates public health and overpopulation concerns.

Key details: Deer: Banned statewide. State Rule: 6 NYCRR 189. Waterfowl: Discouraged. Feral Cats: TNR allowed. DEC Fine: 250 dollars.

State deer feeding violation 250 dollars. Local nuisance citations 100 to 500 dollars. Abatement orders possible for persistent feeding causing neighborhood complaints.

Beekeeping

Beekeeping is permitted in Islip on properties of at least 10,000 square feet with hives set back 25 feet from property lines. Registration with NY Department of Agriculture and Markets Apiary Program is required annually. Up to 4 hives allowed on standard residential lots.

Key details: Min Lot: 10,000 sq ft. Setback: 25 feet. Hive Limit: 4 on residential. Flyway Barrier: 6 feet. Registration: NY Ag and Markets.

250 dollars for unregistered hives, 500 dollars for setback or flyway violations. Bee nuisance complaints may trigger hive removal orders.

Chickens & Livestock

Islip allows residents to keep poultry such as chickens if it does not create a nuisance or health hazard, capping density at 15 birds per 500 square feet of rear-yard enclosure with 10-foot setbacks, while equine livestock requires a Town permit per head.

Key details: Code Section: Islip Town Code Ch. 12, Art. IV. Poultry density: 15 birds per 500 sq ft of rear yard. Setback: 10 ft from side/rear lines; rear yard only. Quiet hours: No audible poultry noise 11 p.m.-7 a.m.. Equine livestock: Town permit per head, 2-year term.

Keeping poultry as a nuisance or health hazard, exceeding the density and setback limits, or keeping equine livestock without the required Town permit violates Chapter 12 Article IV and is enforced by Islip code enforcement with Town Code penalties.

Pet Limits

No Islip-specific ordinance sets a fixed maximum number of household dogs or cats; instead New York's state dog-licensing law applies, and keeping enough dogs to operate a kennel triggers separate Town zoning and licensing requirements.

Key details: Household numeric cap: None in Islip Town Code. Governing state law: NY AGM Sec. 109 (licensing). License age: 4 months. Rabies: Required to obtain a dog license. Kennel-scale keeping: Separate Town license/zoning.

Failure to license a dog over four months old violates NY AGM Sec. 109 and is enforced by the licensing municipality; operating an unlicensed kennel-scale operation violates the Town's animal and zoning rules.

Islip is more permissive than most cities when it comes to pet limits. That said, there are still limits.

Breed Restrictions

Islip has no breed-specific dog ban, and it could not adopt one: New York's Agriculture and Markets Law bars any municipal dangerous-dog program from regulating dogs in a manner that is specific as to breed.

Key details: Local breed ban: None (preempted). State preemption: NY AGM Sec. 107(5). Dangerous-dog test: Behavior-based (NY AGM Sec. 108, 123). Local at-large rule: Islip Town Code Sec. 12-2.

Not applicable; a breed-specific local ban would be preempted and unenforceable under NY AGM Sec. 107(5). Dogs that bite or attack are instead handled as dangerous dogs under AGM Sec. 123 and Town Chapter 12.

If you are coming from a city with tighter rules, you will find Islip gives residents more flexibility on breed restrictions.

Exotic Pets

Islip prohibits wild and exotic animals as pets including large cats, primates, venomous reptiles, and crocodilians per Town Code Chapter 15 and NY Environmental Conservation Law 11-0512. Suffolk County also bans ferrets in some contexts. Domestic pets like dogs, cats, rabbits, guinea pigs, and most birds are permitted.

Key details: State Law: ECL 11-0512. Banned: Big cats, primates, venomous. Permitted: Standard domestic pets. Fine: 1,000 dollars plus seizure.

First offense 1,000 dollars plus animal seizure and sanctuary placement costs. Criminal charges possible under ECL for dangerous species.

Compared to other cities, Islip takes a harder line on exotic pets. The enforcement and penalty structure reflects that.

The Bottom Line

Islip's animal ordinances rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Islip is broadly strict or permissive.
