Colonie's Business Licensing & Operations: The Rules That Matter

By CityRuleLookup Editorial Team

If you live in Colonie or are thinking about moving there, business licensing & operations are one of those things you probably won't think about until they affect you directly. Colonie has 2 specific rules on the books covering different aspects of business licensing & operations, and some of them might surprise you.

Tobacco Retail License

Colonie tobacco retailers are licensed at the state level. New York Public Health Law §1399-aa through §1399-mm sets the statewide minimum sales age of 21 for all tobacco and vapor products (NY Tobacco 21), and the NY Department of Taxation and Finance issues the Certificate of Registration for Retail Dealers of Cigarettes and Tobacco Products under Tax Law §480-a. Colonie has not enacted a separate municipal tobacco license.

Key details: State Age: 21 (PHL §1399-cc). State License: NY Tax Dept. Certificate of Registration (Tax Law §480-a). Vapor License: Vapor products dealer registration. Local License: None separate from state. Indoor Smoking: Banned (PHL Article 13-E).

Selling tobacco or vapor products to a person under 21 is punishable under PHL §1399-ee with civil penalties starting at $300 for a first offense and rising to $1,500 for subsequent offenses within three years, plus possible registration suspension by the NY Department of Taxation and Finance. NY Tax Law §1814 criminalizes willful failure to obtain a tobacco registration, with felony exposure for repeat offenses. Albany County DOH ATUPA inspectors document violations.

This is one of the stricter rules in Colonie's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Secondhand Dealers

Pawnbrokers and secondhand dealers in Colonie are regulated primarily under New York General Business Law (GBL) Article 5 (§§40-55) for pawnbrokers and Article 6 (§60 et seq.) for dealers in secondhand articles. The Town of Colonie has home-rule authority under GBL §60 to require local licensing of secondhand dealers and pawnbrokers, with mandatory transaction recordkeeping and police reporting.

Key details: Pawnbroker Statute: NY GBL Article 5 (§§40-55). Secondhand Statute: NY GBL Article 6 (§60 et seq.). Local Authority: Colonie Town Board licenses both. Hold Period: Set by local law (commonly 15 days). Recordkeeping: Required by GBL §44 / §60.

Operating a pawnshop without a license under GBL Article 5 is a misdemeanor under GBL §50, punishable by fine and imprisonment, and the unredeemed pledge can be ordered returned. Failing to register or report transactions as a secondhand dealer under a Colonie local law adopted under GBL §60 carries fines and license revocation. NY Penal Law §165.55 (criminal possession of stolen property) can apply if a dealer knowingly receives stolen goods.

This is not one of those rules that cities tend to ignore. Colonie actively enforces its secondhand dealers requirements.

The Bottom Line

Colonie is tougher than many cities when it comes to business licensing & operations. Out of the 2 rules covered here, 2 are rated strict. If you are a homeowner, renter, or business owner in Colonie, take the time to understand these requirements before they become a problem. Most violations come with fines, and some repeat violations can escalate.

Keep in mind that Colonie can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
