El Monte's Fence Regulations: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles fence regulations a little differently. In El Monte, California, there are 8 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Fence Requirements

Fences and walls in El Monte are regulated under Title 17 (Zoning), with general development standards in Chapter 17.60. Front-yard fences are limited to 42 inches in residential zones, side and rear yards up to 6 feet, and 8 feet between commercial/industrial and residential zones with planning approval.

Key details: Front-Yard Max Height: 42 inches (3.5 ft). Side / Rear Yard Max: 6 feet. Commercial-to-Residential Wall: 6-8 ft masonry required. Prohibited Materials: Razor wire, barbed wire, electrified (residential).

Building or maintaining a fence taller than the allowable height or in a prohibited material is a zoning violation under EMMC Title 17. Code enforcement can require removal and impose administrative citations under Chapter 1.20 starting at $100 for a first offense, escalating to $500.

Approved Materials

Chain-link is prohibited for residential uses. Barbed, pointed, spiked, razor, or piercing materials are banned on any fence or wall citywide.

Key details: Barbed/razor wire: Prohibited citywide on all fences. Chain-link in residential: Prohibited (permanent). Commercial front fence material: Solid masonry or wrought iron. Temporary construction fence: Chain-link allowed (EMMC § 17.50.070). Code section: EMMC § 17.60.120.

Non-compliant materials must be removed under a code-enforcement Notice of Violation. General penalty under EMMC Chapter 1.20 applies: $100/$200/$500 escalating fines, with continuing violations chargeable as misdemeanors.

This is not one of those rules that cities tend to ignore. El Monte actively enforces its approved materials requirements.

Pool Barriers

Residential pool enclosures must be at least 60 inches tall with self-closing, self-latching gates opening away from the pool. Vertical member spacing capped at 1-3/4 inches.

Key details: Minimum barrier height: 60 in (5 ft). Gate latch height: 54 in minimum above ground. Vertical member spacing: Max 1-3/4 in. Bottom clearance: Max 2 in from grade. Gate swing: Outward, away from pool.

Building inspections fail if barriers are deficient — pool cannot receive final approval/water until corrected. Operating a pool without a compliant barrier is a public nuisance subject to abatement. Civil liability under HSC § 115928 may attach if a drowning occurs in a non-compliant pool. EMMC Chapter 1.20 general penalties ($100/$200/$500) apply for code-enforcement actions.

This is one of the stricter rules in El Monte's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Neighbor Fence Rules

California Civil Code § 841 (the Good Neighbor Fence Act) presumes adjoining owners share equally in the cost of a boundary fence. 30-day written notice is required before incurring costs.

Key details: Governing law: Cal. Civil Code § 841. Default cost split: 50/50. Written notice required: 30 days before incurring cost. Local fence height/material: Must still meet EMMC § 17.60.120. Dispute venue: LA County Superior Court.

Cost-sharing disputes are civil matters resolved in California Superior Court (Los Angeles County). Failure to give the required 30-day notice can defeat a cost-recovery claim. Encroaching fences (over the property line) can lead to civil trespass actions and forced removal.

Material Restrictions

El Monte allows decorative wrought iron fencing up to 5 ft in front yards if at least 50% open with decorative block pilasters (Sec. 17.60.120). Solid fences in front yards limited to 4 ft. Commercial/industrial abutting residential requires 6 ft masonry wall.

Key details: Front Yard: 4 ft solid, 5 ft if 50% wrought iron. Masonry Required: Commercial abutting residential. Rear/Side: 6 ft max, standard materials. Code: Sec. 17.60.120.

Non-approved materials face code enforcement. Planning Director approval is required for non-standard materials.

Retaining Walls

Retaining walls over 4 feet (measured bottom of footing to top) require a building permit under the California Building Code, adopted by El Monte in EMMC Title 15.

Key details: Permit threshold: Over 4 ft (bottom of footing to top). Permit threshold with surcharge: Any height. Authority: CBC § 105.2 via EMMC Title 15. Combined wall + fence height: Counts toward EMMC § 17.60.120 limit. Engineered plans: Required for walls over 4 ft.

Walls built without required permits are subject to stop-work orders and double permit fees under Title 15. Structural failure or unpermitted walls over 4 ft can be declared a public nuisance under EMMC Chapter 8 and abated at the owner's expense. Standard penalties under EMMC Chapter 1.20 apply: $100/$200/$500.

Height Limits

Residential fences max 6 ft in rear/interior side yards, 4 ft in required front yards. A 5-ft front-yard fence allowed if at least 50% decorative wrought iron with block pilasters.

Key details: Front-yard max: 4 ft solid (5 ft if 50%+ wrought iron). Rear/side-yard max: 6 ft. Street side yard (within 10 ft): 4 ft. Commercial/industrial max: 6 ft. Permit required: Yes for fences over 6 ft (per CBC §105.2).

Code enforcement issues a Notice of Violation requiring removal or modification within a stated compliance period. Continued violations are addressed under El Monte Municipal Code Chapter 1.20 (General Penalty) — infractions $100 first offense, $200 second, $500 each additional within one year. Persistent violations may be charged as misdemeanors.

Permit Requirements

Fence permits in El Monte are required for walls and fences above certain heights. The Building & Safety Division processes fence permits. Fences in the street side yard within 10 ft of the street cannot exceed 4 ft.

Key details: Permit: Required for taller fences. Street Side: 4 ft max within 10 ft of street. Exception: 5 ft with 50% wrought iron. Review: Building & Safety Division.

Unpermitted fences face code enforcement. Contact the Building and Safety Division or Planning Division.
