Sun Prairie's Fence Regulations: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles fence regulations a little differently. In Sun Prairie, Wisconsin, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Height Limits

Sun Prairie regulates fences under Title 17 (Zoning), Section 17.36.200 of the Municipal Code. Residential fences may not exceed six (6) feet in height, except within twenty (20) feet of a street yard property line, where the maximum is four (4) feet. Fences along side and rear lot lines may sit on the property line, but must be set back at least two (2) feet from the street yard (front) property line. A building permit issued by the Sun Prairie Building Inspection Division (300 E. Main Street) is required prior to installation, and a final inspection verifying location, height, and materials is mandatory.

Key details: Rear/Side Yard Maximum: 6 ft. Street Yard / Front (within 20 ft of ROW): 4 ft maximum. Street Yard Setback: Minimum 2 ft from front property line. Side/Rear Property Line Setback: May sit on the property line. Corner Lot 6-ft Side Yard Fence: Allowed only with administrative Special Use Permit.

Constructing a fence taller than the 6-ft (rear/side) or 4-ft (street yard) limits, encroaching within the 2-ft street-yard setback, using prohibited materials (barbed wire, razor wire, electric wire, or chain link/wire mesh in front yards), or installing a fence without a building permit can trigger municipal enforcement by the Building Inspection Division. Owners may be ordered to remove or modify the fence and may face citations and forfeitures prosecuted in Dane County Circuit Court. A required final inspection that fails (for incorrect location, height, or materials) must be corrected before the permit is closed.

Neighbor Fence Rules

WI Stat. Β§90.02 to 90.14 provides line fence cost-sharing for rural/agricultural land. Urban residential fences: each owner responsible for their own.

Key details: Rural: Cost-sharing statute (Β§90.02). Urban: Each owner responsible. Disputes: Town supervisor (rural). Written Agreement: Recommended.

Civil dispute for cost-sharing in urban areas. Rural: town supervisor adjudication per Β§90.02. Property line encroachments: survey and civil remedy.

The Bottom Line

Sun Prairie's fence regulations rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Sun Prairie is broadly strict or permissive.

Keep in mind that Sun Prairie can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
