Fire Regulations in Santa Cruz, CA: What Residents Actually Need to Know

By CityRuleLookup Editorial Team

If you live in Santa Cruz or are thinking about moving there, fire regulations are one of those things you probably won't think about until they affect you directly. Santa Cruz has 6 specific rules on the books covering different aspects of fire regulations, and some of them might surprise you.

Brush Clearance

Santa Cruz adopts the California Fire Code Wildland-Urban Interface chapter under §19.05.270 plus a local Wildfire Risk Areas chapter (Title 19 §19.05.310 / Fire Code Ch. 90).

Key details: Code: §19.05.310, §19.20.010. State Rule: PRC §4291 (100 ft). Spark Arresters: Required (Fire Code §9005).

Failure to maintain defensible space supports administrative abatement and cost-recovery liens. Wildfire risk area trespass during closure is enforced by the fire chief.

Compared to other cities, Santa Cruz takes a harder line on brush clearance. The enforcement and penalty structure reflects that.

Fire Pit Rules

Portable outdoor fireplaces and fire pits are allowed in Santa Cruz but must follow the manufacturer's instructions and be kept at least 15 feet from any structure or combustible material (with an exception for use at one- and two-family dwellings), and must be constantly attended. Open fires are prohibited on all City beaches.

Key details: Code Section: SCMC 19.05.120 (CFC 307.4.3). Fire pit clearance: 15 ft from structures (except 1-2 family dwellings). Bonfire clearance: 50 ft unless in a barbecue pit (CFC 307.4.1). Beaches: No fires on any City beach; charcoal BBQs banned.

Operating a fire pit or portable fireplace too close to a structure, leaving it unattended, or lighting an open fire on a City beach is a Fire Code violation; the fire code official may order extinguishment under SCMC 19.05.120 (CFC 307.3).

Wildfire Zones

Santa Cruz adopts the CAL FIRE Fire Hazard Severity Zone map under §19.20.010, triggering wildland-urban interface (WUI) building and defensible-space requirements citywide for designated zones.

Key details: Code: §19.20.010. State Authority: Gov. Code §51178. Triggers: WUI building (CBC Ch. 7A).

WUI building violations are enforced by the fire code official and chief building official under §19.05.070. Defensible-space failure supports abatement under PRC §4291.

This is one of the stricter rules in Santa Cruz's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Outdoor Burning

Open burning in Santa Cruz requires a Fire Department burn permit ($50), is limited to parcels of one-half acre or larger, and is generally allowed only during the December 1 - April 30 burn season on declared burn days. Burning is prohibited on parcels under half an acre (except where yard-waste pickup is unavailable) and within 100 feet of a neighbor's structure.

Key details: Code Section: SCMC 19.05.120 (CFC 307.2-307.5). Burn season: Dec 1 - Apr 30, burn days only. Permit: $50; parcel 1/2 acre or greater; owners only. Burn hours: 8 a.m. to 4 p.m.; verify via 1-800-CAL-BURN.

Burning without a required permit or outside permitted conditions is a Fire Code violation enforceable by the fire code official, who under SCMC 19.05.120 (CFC 307.3) may order extinguishment. Property owners 'may be held liable if a fire escapes their control and/or burns the property of a neighbor.'

Compared to other cities, Santa Cruz takes a harder line on outdoor burning. The enforcement and penalty structure reflects that.

Fireworks

All fireworks - including 'safe and sane' - are prohibited to possess, manufacture, store, sell, handle, or use anywhere in the City of Santa Cruz. The City deletes the state Fire Code's fireworks chapter and replaces it with an outright ban, and fines triple during the July Fourth safety enhancement zone period.

Key details: Code Section: SCMC 19.05.300 (CFC 5601.1.2). Local rule: ALL fireworks prohibited, including 'safe and sane'. Triple fines: SCMC 9.02.020 safety enhancement zone (July 4). State law: Cal. Health & Safety Code section 12677.

Possession or discharge is a Municipal Code violation; under SCMC 9.02.020 the fine is tripled within a designated safety enhancement zone (the city limits during the Fourth of July period) - 'three times the amount of the fine assessed per the city of Santa Cruz bail schedule.' Possession of dangerous fireworks without a permit is also a misdemeanor under Cal. Health & Safety Code section 12677.

This is one of the stricter rules in Santa Cruz's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Backyard Fires

The City of Santa Cruz allows backyard recreational and warming fires daily unless wildfire danger is high. The fire must be no more than 3 feet in diameter and 2 feet high, kept at least 25 feet from any structure or combustible material, constantly attended with extinguishing equipment on hand, and may be ordered out by the Fire Department if deemed unsafe.

Key details: Code Section: SCMC 19.05.120 (CFC 307.4.2, 307.5). Max size: 3 ft diameter, 2 ft high fuel area. Clearance: 25 ft from structures/combustibles. Attendance: Constantly attended; 4-A extinguisher on hand.

An unsafe or non-compliant fire may be ordered extinguished by the Santa Cruz Fire Department or fire code official under SCMC 19.05.120 (CFC 307); failure to attend a fire or maintain required clearance and extinguishing equipment is a Fire Code violation.

The Bottom Line

Santa Cruz is tougher than many cities when it comes to fire regulations. Out of the 6 rules covered here, 4 are rated strict. If you are a homeowner, renter, or business owner in Santa Cruz, take the time to understand these requirements before they become a problem. Most violations come with fines, and some repeat violations can escalate.

These rules come from Santa Cruz's publicly available municipal code. For complete penalty schedules, exemption details, and answers to common questions, see the individual ordinance pages throughout this guide.
