Summary

Before erecting, altering, moving, or demolishing any building or structure in unincorporated Mendocino County, an owner must get a separate building permit from the Department of Planning and Building Services for each structure. Fees follow a schedule the Board of Supervisors adopts by resolution, and building without a required permit draws a violation fee on top of the normal permit cost.

These county ordinances apply to unincorporated areas of Mendocino County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Except as otherwise exempted by the California Building Code and/or other county ordinances, no person, firm, or corporation shall erect, construct, enlarge, alter, repair, move, improve, occupy, remove, convert, or demolish any building or structure in the unincorporated area of the County or cause the same to be done without first obtaining a separate building permit for each such building or structure as required by this Title. Permits shall be issued and fees collected by the Planning and Building Services Department. The schedule of fees collected is adopted from time to time by the Board of Supervisors of the County of Mendocino.

Full Breakdown

010 bars anyone from erecting, constructing, enlarging, altering, repairing, moving, improving, occupying, removing, converting, or demolishing a building or structure in the unincorporated county without first getting a separate building permit for each structure, except where the California Building Code or another county ordinance exempts the work. The Planning and Building Services Department issues permits and collects fees under a schedule the Board of Supervisors adopts by resolution, and valuation for fee purposes is based on building valuation data published by the International Code Council, or RSMeans Square Foot Cost data at the Building Official's discretion, per Sec.

040. 015 blocks issuance of any building permit for a project that Title 20 or 21 requires to have a certified environmental impact report until that EIR is complete. 13) disclosures before certain discretionary actions or building permits issue. Once issued, Sec. 025 requires the building permit card to be posted conspicuously and kept accessible to building inspectors until the project is complete.

Violations & Fines

Under Sec. 18.08.030, anyone doing work without the required permit pays a violation fee on top of the normal permit fee: an amount equal to the permit fee if the owner or applicant self-reports the violation, or for minor over-the-counter projects like re-roofing or water heaters regardless of who reports it; twice the permit fee if the county's Planning and Building Services Department discovers the violation through a complaint; and three times the permit fee for a commercial or industrial structure. The county determines which multiplier applies based on the property's actual use, not its zoning designation, and recovers its enforcement costs at hourly rates the Board of Supervisors sets by resolution.

Frequently Asked Questions

Do I need a permit to remodel my house in unincorporated Mendocino County?
Yes. Section 18.08.010 requires a separate building permit for each structure before you erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish it, unless the California Building Code or another county ordinance specifically exempts the work.
What happens if I build without a permit and the county finds out?
You pay a violation fee in addition to the normal permit fee. Section 18.08.030 sets that fee at twice the normal permit cost if the county discovers the work through a complaint, and three times the cost for a commercial or industrial structure.
Does self-reporting unpermitted work in Mendocino County lower the penalty?
Yes, for most residential projects. Section 18.08.030(C) charges only the normal permit fee amount, rather than the doubled complaint-triggered fee, when the owner or applicant brings the unpermitted work to the county's attention first.
