Summary

Prince William County's Child Care Service Providers ordinance requires every person providing paid child care in a covered facility to hold certified pediatric or infant/child CPR training, renewed every two years, and to prove it to the zoning administrator before zoning approval issues or renews.

These county ordinances apply to unincorporated areas of Prince William County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Child care services shall mean the provision of regular care, protection and guidance to one or more children not related by blood or marriage while such children are separated from their parent, guardian or legal custodian in a structure not the residence of the child during a part of the day for at least four days of a calendar week. Child care facilities shall include any commercial or residential structure which is used to provide child care services, but shall exclude any child care facility licensed by the state. ... At all times during which child care services are being provided for compensation in a child care facility, all persons providing child care services shall have successfully completed a certified pediatric CPR training course or a certified infant and child CPR course before providing child care services. ... Persons providing child care services for compensation... shall maintain proficiency in such training by successfully completing periodic retraining not less than every two years.

Full Breakdown

County Code Chapter 6 applies to "child care facilities," defined in § 6-1 as any commercial or residential structure used to provide child care services, but the definition carves out any facility already licensed by the state as a child care facility and any facility run by a religious institution exempt from that state licensure. "Child care services" is defined as regular care, protection and guidance provided to unrelated children away from the child's own home for part of the day, at least four days a week.

Section 6-2(a) requires that at all times paid child care services are being provided in a covered facility, every person providing that care must have successfully completed a certified pediatric CPR training course or a certified infant and child CPR course before providing services. Subsection (b) requires ongoing proficiency through periodic retraining no less often than every two years, and subsection (c) ties enforcement to the zoning process: at initial application for zoning approval to run child care services, and at every renewal, facility representatives must give the zoning administrator evidence satisfactory to that office that the CPR training has been obtained and proficiency maintained by everyone currently providing care.

Section 6-3 makes clear these CPR duties are additional to, not a substitute for, every other applicable state and local requirement, including state child care licensing where it applies. Section 6-4 phased the rule in: it applied immediately to facilities that began operating on or after the May 7, 1996 effective date, while facilities already operating could continue until their next zoning-approval renewal or one year after the effective date, whichever came first.

Violations & Fines

Because § 6-2(c) makes CPR compliance a condition of the underlying zoning approval, a facility that cannot show the zoning administrator satisfactory evidence of current, properly renewed CPR certification for everyone providing care risks denial or non-renewal of its zoning approval to operate, separate from any state child care licensing consequence for the same facility.

Frequently Asked Questions

Which child care facilities does this county ordinance cover?
Chapter 6 covers commercial or residential structures used to provide regular child care to unrelated children for part of the day at least four days a week, but it excludes any facility already licensed as a child care facility by the state and any exempt religious-institution facility.
What CPR training is required for child care staff?
Section 6-2(a) requires everyone providing paid child care services in a covered facility to have completed a certified pediatric CPR training course or a certified infant and child CPR course before providing services, with retraining required at least every two years under subsection (b).
How does the county confirm CPR compliance?
Section 6-2(c) requires facility representatives to give the zoning administrator satisfactory evidence, at the time of applying for zoning approval to provide child care and at each renewal, that the required CPR training has been obtained and kept current for everyone providing care.
Does this CPR rule replace state child care licensing requirements?
No. Section 6-3 states these CPR requirements are in addition to, not in lieu of, all other applicable state and local requirements, so a facility must still satisfy any state child care licensing rules that apply to it.
