San Luis Obispo County, CA Building Safety: Childcare Center Rules (2026)

Sec. 170 sets standards for large family day care homes and child care centers on top of state licensing under Title 22 of the California Code of Regulations. Subsection B requires Conditional Use Permit approval for any child care center serving 13 or more children, a stricter permit tier than the Zoning Clearance or Minor Use Permit path available to smaller family day care homes under Subsection A. Site location standards in Subsection C apply to both centers and large family day care homes: the access street must be paved or publicly maintained with clear width sufficient for on-street parking entirely outside the travel lanes, and no facility may be approved within the same block or within 500 feet of another large family day care home or child care center in a residential single-family category, absent a Minor Use Permit authorizing an exception.

Subsection D requires every outdoor play area to be enclosed with fencing at least four feet high, and the fence must be solid and at least six feet high anywhere it abuts a residential use on an adjoining lot, where the Director determines that height is needed for effective noise control. next to single-family residential parcels unless the play area sits at least 100 feet from any dwelling besides the applicant's, or a Minor Use Permit or Conditional Use Permit specifically authorizes earlier hours.
