Summary

A day-care center in unincorporated Harford County is a special exception, not a by-right use, and needs Board of Appeals approval. Zoning Code § 267-88C(4) sets a half-acre minimum lot, arterial or collector access, and a fenced, buffered outdoor play area.

These county ordinances apply to unincorporated areas of Harford County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Day-care centers.

Full Breakdown

Harford County Code § 267-88C(4) governs stand-alone day-care centers as a special exception under the Board of Appeals, enumerated at § 267-9. In the AG, RR, R1, R2, R3, R4 and VR Districts, the facility needs at least a half-acre parcel, access from an arterial or collector road, and an outdoor play area fenced and located in the rear of the building, screened from adjacent residential lots by a Type "B" buffer under § 267-30. A converted existing structure is allowed, but new construction must match the architecture of the surrounding neighborhood.

In the CI, LI and GI industrial districts the bar is higher: access must be from a public road, the play area must be fenced and buffered to cut children's exposure to road and industrial noise, and the operator must file emergency evacuation and sheltering plans with the county's Emergency Operations Division and the three closest volunteer fire and ambulance companies before opening. The Board can deny an industrial-district application outright if a nearby industrial use poses a hazard to the children. A center run inside a church, private school or public school is treated differently: if it already holds a zoning certificate as an accessory use under § 267-27, it is exempt from these § 267-88C(4) siting standards.

The zoning fee schedule at § 157-25B(5) separately sets a $100 filing fee for a day-care center special-exception application, on top of the $200 publication and posting fee.

Violations & Fines

Operating a day-care center without the required Board of Appeals special exception, or in violation of the approved site plan's lot size, access, buffer or play-area conditions, is a zoning violation enforceable by the Department of Planning and Zoning through a zoning certificate revocation or citation process. A special exception grant is limited to the site plan the Board approved; any substantial change requires further Board approval under § 267-87B.

Frequently Asked Questions

Can I open a day-care center anywhere zoned residential in Harford County?
No. Under Harford County Code § 267-88C(4), a day-care center is a special exception in the AG, RR, R1 through R4 and VR Districts, meaning you need Board of Appeals approval, a half-acre minimum lot, arterial or collector access, and a fenced, buffered rear play area, not an automatic permit.
Is a church-based day-care exempt from the siting rules?
Yes, if the day-care center operating in a church, private school or public school already holds a zoning certificate as an accessory use under § 267-27, § 267-88C(4)(5) exempts it from the special exception siting standards that apply to a stand-alone facility.
What must an industrial-district day-care operator file before opening?
Under § 267-88C(4)(b), before opening in the CI, LI or GI Districts the operator must file emergency evacuation and sheltering plans with the county's Emergency Operations Division and the three closest volunteer fire and ambulance companies.
