Summary

Marin County Code Section 19.04.110 adopts local green building measures on top of the 2025 California Green Building Standards Code and 2025 California Energy Code, requiring covered projects to meet CALGreen Tier 1 and electrification standards tied to Marin's wildfire, sea-level-rise, and seismic risks. The Community Development Agency's Building and Safety Division enforces these mandatory measures.

City-specific rules exist: San Rafael has its own green building code rules that differ from Marin County's county-level regulations. If you live in San Rafael, check the city-specific page instead.

The purpose of this chapter is to meet or exceed all applicable mandatory measures of the 2025 California Green Building Standards Code (Title 24, Part 11) and 2025 California Energy Code (Title 24, Part 6) of the California Code of Regulations. Pursuant to Health and Safety Code Sections 17958.7 and 18941.5, the Marin County Board of Supervisors hereby finds the following green building modifications to California Green Building Standards Code Chapters 3, 4 and 5, as set forth in this subchapter, are reasonably necessary to address local climatic, geologic, environmental and/or topographic conditions that affect the health, safety, and welfare of residents, including flooding/sea level rise, wildfire risk, and seismic risk.

Full Breakdown

Under Section 19.04.110, the Marin County Board of Supervisors adopted local amendments to California Green Building Standards Code (CALGreen) Chapters 3, 4, and 5, finding them reasonably necessary under Health and Safety Code Sections 17958.7 and 18941.5 because of Marin's exposure to flooding and sea-level rise, wildfire, and seismic activity. The chapter's stated purposes, listed in Section 19.04.110, include increasing energy efficiency, reducing fossil fuel use, encouraging water and resource conservation, cutting construction waste, improving indoor air quality, and encouraging all-electric buildings, while requiring covered projects to meet all mandatory measures of the 2025 CALGreen Code (Title 24, Part 11) and 2025 California Energy Code (Title 24, Part 6).

Covered projects, defined in Section 19.04.110 as additions or alterations to existing single-family, multifamily, hotel/motel, or nonresidential buildings needing a building permit, must meet compliance thresholds set out in the Table 1 standards of Section 19.04.140, which vary by project type and size and include CALGreen Tier 1 measures plus electric-vehicle infrastructure requirements. Section 19.04.135 further amends CALGreen so that, when a project's electrical service panel is modified, the panel and any on-site transformers must have enough capacity to simultaneously charge twenty percent of on-site parking spaces at Level 2 EV-Ready. The chapter also exempts temporary buildings such as construction trailers, unconditioned space, and buildings on a historic register from these requirements, and lets an applicant request a hardship or infeasibility exemption from the chief building official, appealable in writing if denied.

Violations & Fines

Failing to meet the mandatory CALGreen and Energy Code measures required by this chapter blocks issuance of the building permit or final inspection sign-off for the covered project; it is not treated as a separate misdemeanor. An applicant who disagrees with the chief building official's compliance determination, or a denied hardship exemption, must file a written appeal rather than proceed with noncompliant construction.

Frequently Asked Questions

What green building standard applies to remodels in unincorporated Marin County?
Section 19.04.110 requires covered additions and alterations to meet all mandatory measures of the 2025 California Green Building Standards Code (CALGreen) and 2025 California Energy Code, plus local Division A4.6 Tier 1 measures. The specific thresholds depend on project type and size, set out in the Table 1 standards of Section 19.04.140.
Does Marin County require EV charging capacity when I remodel?
Yes, if you modify the electrical service panel. Section 19.04.135 requires the panel and any on-site transformers to have enough capacity to simultaneously charge twenty percent of on-site parking spaces at Level 2 EV-Ready, for multifamily and nonresidential additions or alterations covered by this chapter.
Can I get out of Marin County's green building requirements if they're too costly?
You may apply for a hardship or infeasibility exemption from the chief building official if compliance cost is disproportionate to the project or would create a safety hazard, under this chapter's exemption provisions. The official sets the maximum feasible compliance threshold, and a denial can be appealed in writing.
Are historic buildings exempt from Marin County's green building code?
Yes. The chapter's exemptions exclude any requirement that would impair the historic integrity of a building listed on a local, state, or federal historic register, as determined by the chief building official under the California Historic Building Code, Title 24 Part 8, which may include requiring an architectural historian's evaluation.
