Summary

Unincorporated St. Clair County adopts the Illinois State Plumbing Code, 77 Ill. Adm. Code Part 890, as its own plumbing code under Building Regulations Sec. 7-12-1. Any new plumbing installation, alteration or replacement needs a permit from the Building and Zoning Department before work starts, and enforcement follows the state code's own terms under Sec. 7-12-3.

These county ordinances apply to unincorporated areas of St. Clair County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

7-12-1 Adoption of Illinois Plumbing Code. The Illinois State Plumbing Code, 77 Illinois Administrative Code, Part 890, as amended and promulgated by the Illinois Department of Public Health, and as may be amended from time to time, is hereby adopted as the Plumbing Code of St. Clair County, Illinois by the St. Clair County Board, to govern the design and installation of new plumbing or plumbing systems and the alteration, renovation, or replacement of plumbing or plumbing systems, as if fully set forth in this Article XII. Each and all of the regulations, provisions, penalties, conditions and terms of said Illinois State Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this Article. A copy of the Illinois State Plumbing Code is on file in the office of the Zoning Administrator of St. Clair County. 7-12-3 Plumbing Enforcement. All enforcement shall be in compliance with the State Plumbing Code.

Full Breakdown

St. Clair County adopts the Illinois State Plumbing Code as its own plumbing code rather than writing local plumbing standards from scratch. Sec. 7-12-1, in Article XII of the Building Regulations, adopts "77 Illinois Administrative Code, Part 890, as amended and promulgated by the Illinois Department of Public Health," and folds in "each and all of the regulations, provisions, penalties, conditions and terms" of that state code, governing new plumbing systems and any alteration, renovation or replacement of an existing one. A copy of the adopted code is kept on file in the Zoning Administrator's office for reference.

Sec. " The permit itself is obtained under the general Division V permit requirement, Sec. 7-1-27, which covers anyone who intends to erect, install, enlarge, alter, repair, remove, convert or replace any plumbing system regulated by the code; the building official will not release the permit until fees are paid (Sec. 7-2-45). The fee is set under Sec. 7-2-46 by the schedule adopted in County Ordinance No. 13-1087 (11-25-13), covering building, electrical, gas, mechanical and plumbing work alike, and building permit valuation folds in plumbing equipment and materials under Sec.

7-2-47. Only narrowly defined minor work skips the permit step: stopping a leak or clearing a stoppage that does not require replacing pipes, valves or fixtures (Sec. 7-1-28(E)); a defective concealed pipe that must be removed and replaced is treated as new work and needs both a permit and inspection.

Violations & Fines

Installing, altering or replacing plumbing without a permit is enforced the same as any other building code violation: a notice of violation from the building official, followed by petty-offense prosecution under the Unified Code of Corrections (730 ILCS 5/5-4.5-75) if not corrected, per Sec. 7-1-82. Because the county adopted the Illinois State Plumbing Code's own penalties wholesale, the state code's separate enforcement terms also apply, and work begun before a permit issues draws an added fee on top of the standard permit charge under Sec. 7-2-50.

Frequently Asked Questions

Do I need a permit to replace a water heater or repair a leaking pipe in unincorporated St. Clair County?
Yes for new work or a replacement system; Sec. 7-1-28(E) exempts only the stopping of minor leaks and the clearing of stoppages that do not require replacing pipes, valves or fixtures. Removing and replacing a defective concealed pipe counts as new work and needs a permit and inspection under the adopted Illinois State Plumbing Code.
What plumbing code does the county actually enforce?
Sec. 7-12-1 adopts the Illinois State Plumbing Code, 77 Illinois Administrative Code Part 890, as promulgated by the Illinois Department of Public Health, as the county's own Plumbing Code, word for word, including that code's regulations, penalties and conditions.
Who issues plumbing permits and where is the fee set?
The Building and Zoning Department issues plumbing permits, and the fee is charged under the schedule adopted by County Ordinance No. 13-1087 (11-25-13), the same ordinance that sets building, electrical, gas and mechanical permit fees under Sec. 7-2-46.
